Please read these Terms of Service ("Terms", "Agreement") carefully before using the Think With Me desktop application and website located at thinkwithme.io (collectively, the "Service"), operated by ThinkWithMe ("we", "us", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.
You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
To access certain features, you must register for an Account. You agree to provide accurate, current, and complete information during registration and to keep your Account information up to date. You are responsible for safeguarding your Account credentials and for all activities that occur under your Account. You must notify us immediately at [email protected] if you suspect unauthorized access to your Account.
Think With Me is an AI-powered voice assistant desktop application for Windows. The Service provides:
Features may vary by subscription plan. We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice.

Current pricing is displayed on our pricing page. Prices are in US Dollars (USD) and are subject to change with 30 days' notice.
All payments are processed by our authorized payment provider, Dodo Payments. By making a purchase, you also agree to Dodo Payments' Terms of Service and Privacy Policy. Dodo Payments acts as the Merchant of Record for all transactions. We do not store your payment card details on our servers.
Monthly subscriptions are billed in advance on the same day of each month. Included hours are granted at the start of each billing period and do not roll over to the next period. Unused hours expire at the end of each billing cycle.
You may cancel your subscription at any time through your account dashboard or by contacting [email protected]. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of your paid period. No partial refunds are issued for unused time within a billing cycle.
Refund requests are handled on a case-by-case basis. If you are unsatisfied with the Service, please contact us within 7 days of your purchase at [email protected]. We reserve the right to grant or deny refund requests at our sole discretion.
You retain all rights to the Content you create or provide through the Service. We do not claim ownership of your Content.
Voice recording and transcription are performed locally on your device using OpenAI Whisper. No audio data is transmitted to our servers.
Your AI prompts are routed through our cloud API to the selected AI provider (OpenAI, Anthropic, or Google), and responses are relayed back to your device. All data in transit is encrypted using TLS 1.2 or higher. Session data is stored to provide conversation history and continuity features. You can delete your sessions at any time.
In Flex Mode, you provide your own API keys which are securely stored and used solely to authenticate requests to the AI provider you select. You are responsible for managing your own API keys and can update or delete them at any time through the application settings.

The Service, including the Application, website, branding, logos, documentation, and all associated intellectual property, is owned by ThinkWithMe and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the Service except for the limited license to use it in accordance with these Terms.
You are granted a non-exclusive, non-transferable, revocable license to use the Application solely for personal or internal business purposes, subject to these Terms and your active subscription.
The Service integrates with third-party AI providers including OpenAI, Anthropic, and Google. Your use of these providers is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service.
Payment processing is provided by Dodo Payments. By using paid features, you acknowledge and agree to Dodo Payments' terms as referenced in Section 5.2.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

You acknowledge that AI-generated responses may contain errors, inaccuracies, or inappropriate content, and you use such content at your own risk and discretion.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THINKWITHME, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless ThinkWithMe and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your Content.
We may terminate or suspend your Account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service ceases immediately.
You may terminate your Account at any time by contacting [email protected]. Sections 6.1 (Ownership), 8 (Intellectual Property), 10 (Disclaimer), 11 (Limitation of Liability), 12 (Indemnification), and 16 (Governing Law) shall survive termination.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. For significant changes, we may also notify you via email or through the Application. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
If any provision of these Terms is held to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and ThinkWithMe regarding the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral.
